Agreement to Terms

Welcome to Trivia Battles! These Terms of Service ("Terms") govern your use of the Trivia Battles mobile application and related services (collectively, the "Service") operated by CraftyGem Studio ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

IMPORTANT: These Terms contain a mandatory arbitration clause and class action waiver that affect your legal rights. Please read them carefully.

Eligibility

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will not use the Service if you are prohibited from doing so under applicable law
• You have not been previously suspended or removed from the Service

Account Registration and Security

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not transfer or share your account with others. We reserve the right to suspend or terminate accounts that violate these Terms.

User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or other malicious code
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scripts) to access the Service
• Attempt to gain unauthorized access to any part of the Service
• Cheat, exploit bugs, or use unauthorized third-party software
• Sell, trade, or transfer your account to others
• Collect or harvest user information without consent
• Use the Service for commercial purposes without our permission

Virtual Items and In-App Purchases

The Service may offer virtual items, coins, or other digital content for purchase ("Virtual Items"). You acknowledge and agree that:

• Virtual Items have no monetary value and cannot be exchanged for real currency
• You do not own Virtual Items; you receive a limited license to use them
• Virtual Items are non-refundable, except as required by law
• We may modify, suspend, or discontinue Virtual Items at any time
• All purchases are final and processed through third-party payment providers
• Prices are subject to change without notice

If you believe a charge was made in error, please contact us within 30 days.

Intellectual Property Rights

The Service and its original content, features, and functionality are owned by CraftyGem Studio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written consent. You may not:

• Copy, modify, or distribute the Service or any portion thereof
• Reverse engineer, decompile, or disassemble the Service
• Remove or alter any proprietary notices or labels
• Create derivative works based on the Service

User-Generated Content

If you submit, post, or share content through the Service ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights
• Your User Content does not contain unlawful, harmful, or offensive material

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

Contests and Competitions

We may offer contests, tournaments, or competitions through the Service. By participating, you agree to:

• Comply with the specific rules and eligibility requirements for each contest
• Accept that decisions regarding winners are final and binding
• Allow us to use your name and likeness for promotional purposes
• Acknowledge that prizes are awarded at our sole discretion

Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your requirements or expectations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRAFTYGEM STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless CraftyGem Studio, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

Dispute Resolution and Arbitration

Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute informally within 60 days.

Binding Arbitration: If the dispute is not resolved informally, you agree that any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Governing Law: These Terms shall be governed by the laws of Israel, without regard to its conflict of law provisions.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• You forfeit all Virtual Items and in-game progress
• All provisions that should survive termination shall survive

You may also terminate your account at any time by contacting us or deleting the application.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and CraftyGem Studio regarding the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
